The information that the BSA have provided about the dispute process is as follows:
- Once the PPV check is complete, an outcome report is sent to the contractor detailing each individual claim that is either marked for recovery or given feedback. The contractor then has 4 weeks from the date of the report to agree or dispute the findings. (If we don’t hear back from them, we always follow up).
- If the contractor does not agree with the report and confirms they wish to dispute, we then send them a dispute template and ask them to list each individual claim they wish to dispute and provide any additional evidence or rationale to support those claims. They then have a further 2 weeks to submit this evidence. (Extensions can be granted on request).
- Once the evidence has been received from the contractor, NHSBSA clinicians review each piece of additional evidence. If any recoveries are reverted due to this additional evidence, a new outcome report is generated and sent to the contractor.
- If the contractor still wishes to contest any of the findings, then we invite them to an informal meeting to discuss those still in dispute. The contractor is at liberty to have a representative attend alongside them; however, it is not expected that the representative speaks on their behalf. If the contractor can provide any further evidence, they should raise this at the meeting, or provide this post meeting, and this will be reviewed again by a clinician. A new outcome report and informal meeting outcome is then sent to the contractor.
- If the contractor still wishes to dispute the findings, this is then moved to Stage 1 Local Resolution, where the local ICB commissioning team assumes responsibility for contacting the contractor and arranging meetings/further evidence requests etc. NHSBSA will send any evidence we have received for these disputed claims, the newest outcome report, and a timeline of events to the commissioning team to help them support the contractor in their dispute.
- If the ICB commissioning team carry out Stage 1 Local Resolution, and the contractor is still wishing to dispute following this, it would then move to Stage 2 NHS Resolution.
